New HOAI comes into force on 01.01.2021

On 06.11.2020, the Bundesrat approved the draft of the Ordinance amending the Fee Regulations for Architects and Engineers (HOAI) submitted by the Federal Government without amendments. The ordinance was published in the Federal Law Gazette on 07.12.2020. This means that the amended HOAI can enter into force as planned on 1 January 2021.

The new HOAI provides an orientation framework for the calculation of fees for architects and engineers. However, associations and chambers of architects and engineers would have liked it to be made clear in the new HOAI that fees must continue to be reasonable in the future. This has been achieved, with some exceptions. Although not in the ordinance itself, but in its explanatory memorandum and in the authorization basis for the enactment of the HOAI, there are clear references to the appropriateness of fees.

Dr. Volker Schnepel, head of the legal department of the Federal Chamber of Architects, informs in the German Architects' Journal which essential changes are to be expected.
