The anticipated expert report on municipal open space statutes has been published. The paper explains the instrumental possibilities of integrating green-blue infrastructure in the settlement area through an open space statute.
By using the instrument of open space statutes in combination with an open space design plan, which the bdla has been promoting for some time, measures for open space qualification and climate adaptation, such as heat and drought prevention, could be increasingly demanded and specified in new construction and renovation projects. The instrument of open space statutes is already being used in a growing number of municipalities, for example in Frankfurt am Main, Kaiserslautern and Regensburg. The report also sets out specific recommendations for anchoring open space statutes in the German Building Code, clarifying the wording "design of the townscape", taking into account climate adaptation or environmental justice, and introducing a green space factor to quantify the minimum proportion of green space per building plot.
Furthermore, the extension of climate adaptation topics such as heat, drought and flood prevention or the use of rainwater in the catalog of regulatory content of the model building code is advocated.
