The Landscape Planning Working Group met in Berlin on 15 February 2019 to hold an in-depth expert discussion on "Contracts for work in environmental planning" with bdla legal counsel Dr. Sebastian Schattenfroh.
The members of the working group informed Dr. Sebastian Schattenfroh about their fields of activity. They explained in which areas and for which clients their own contract bases are or could be used. It became clear that in addition to the classic case - the contractual basis is presented by the client - there are many potential cases of application for a new contract template of the bdla also in the field of landscape and environmental planning.
The legal adviser will subsequently draft a model contract for landscape/environmental planning and present it for discussion as soon as possible. Furthermore, regulations and proposals for subcontractor agreements are to be examined - a topic which is of considerable importance for both open space and landscape planning.
Gudrun Rentsch presented the results of a comprehensive analysis of the application practice regarding § 13b BauGB. Florian Mayer, Head of Division of the Federal Agency for Nature Conservation, supplemented the information from the BfN. The working group asked Gudrun Rentsch to develop an up-to-date argumentation paper on § 13b BauGB on the basis of her preliminary work and as a result of the conference "Update 2019. landscape and environmental development" on 14 and 15 March 2019 in Cologne. This is to be used in discussions with political decision-makers in the run-up to the upcoming BauGB reforms.
Prof. Hubertus von Dressler informed that the event cooperation "Besondere Fachkunde Umweltbaubegleitung" between the Osnabrück University of Applied Sciences and the bdla will be maintained in its proven form. The working group consequently supported the planning to hold the next UBB advanced training in early 2020.
