City and landscape - sustainable and legally secure planning
New requirements due to amendments in building and environmental law
In 2017, important legislative amendments were introduced that have a direct impact on the planning practice of urban and landscape planners.
In the Building Code, the area category Urban Area MU and the aspect of "area" as an environmental concern relevant for consideration have been newly included. The possibility of drawing up accelerated development plans for internal development in accordance with §13a BauGB has been extended to the settlement fringe through §13b. As a result, there are more collisions with protected areas and questions about how to deal with Natura2000 habitat types or species. The EIA Act was amended and the Water Framework Directive was clarified by the Federal Administrative Court with regard to the requirements for the prohibition of deterioration and improvement of water bodies. This results in more specific requirements for planning at water bodies.
Municipalities as well as urban planners and landscape architects are called upon to accept the current requirements for sustainable and legally secure planning. The common goal is to develop a stable green and blue infrastructure in order to contribute significantly to the well-being of the people in our municipalities and to develop synergies with the goals of other disciplines, e.g. for health, immission control, mobility.
The Baden-Württemberg representatives of the Association of German Landscape Architects bdla, the Association for Urban, Regional and State Planning SRL and the EIA Society e.V. support the municipalities and planners in the qualified handling of the new tasks.
Lawyers and experts from approval authorities, planning offices and universities will use practical examples to show the consequences for landscape planning and environmental assessment. The newly established water law assessment and the consideration of human health in planning and environmental assessments are examined in more detail. And fortunately, there are new federal funding opportunities for urban green spaces that can be used to implement the goals of the recently published White Paper on Urban Green Spaces!
