The EU Commission has initiated infringement proceedings against Germany in connection with the calculation of the contract value for planning services.

The infringement proceedings had been initiated "without warning", and a pilot procedure would not be initiated beforehand, according to the Federal Ministry of Economics. Unlike in previous cases, the proceedings are not based on a specific case. Rather, the regulation of § 3 para. 7 sentence 2 VgV ("similar services") is directly attacked.

BAK as well as other associations and institutions are firmly committed not to give in to the EU Commission and, if necessary, to seek clarification from the European Court of Justice. In order to emphasize this concern, BAK, AHO and BIngK have sent a letter to the Federal Minister of Economics Altmaier. Also the municipal umbrella organisations clearly oppose the objective of the EU Commission.
