Onshore wind energy and solar energy - bdla comments on draft legislation

The Association of German Landscape Architects bdla has commented on the Federal Government's draft bill as part of the implementation of RED III into national law.

With RED III, the European Union has not only shown a clear will to further accelerate the expansion of renewable energies, but has also set the legal framework for new possibilities for acceleration with the directive. The bdla is of the opinion that the draft bill presented for the implementation of the EU directive in the area of onshore wind energy and solar energy will only have a limited accelerating effect.

Unfortunately, in the opinion of the bdla, the Federal Government is not implementing RED III in a form that can actually be expected to significantly speed up the approval process. The planned new regulations will lead to further technical and legal uncertainties, which will have a counterproductive effect on the desired acceleration. Unresolved enforcement issues will be shifted to guidelines to be drawn up later or to annexes. The aim should be to ensure that the new legal regulations are comprehensible in themselves and can be applied in planning practice.
